Question: "Exactly what duties and responsibilities will Advantage handle for us?"

Question: "I am an Officer of the Association. Am I personally liable for mistakes the Board of Directors may make?"

Answer: The standard used is "reasonable". Board members are not expected to be experts on everything they encounter. When making decisions, they are expected to use "reasonable care" and "due diligence". Generally, if go to the trouble to find qualified professionals, listen to their opinions and recommendations and select professionals within the parameters that your Association By-Laws allow, you'll avoid personal liability.

Question: "We have a trouble maker in our Association. He questions everything the Board tries to do and is constantly obstructing necessary work by demanding explanations and documentation. Is there anything we can do to stop him?"

Answer: The Association must respond to all written requests received by Certified mail from members. The law dictates the timeframe within which you must respond and provides protection from frivolous requests by limiting what, where and how the Association has to produce records and also allows the Association to charge fees for the production of copies.
